Chapter 12: The Trail

“I didn’t picture Malfoy’s wife that… fat.” Ron commented.

“She’s pregnant!” Hermione gasped and told Ron at the same time.

“WHAT?” Ron asked a little too loud.

“Shh!” Hermione snapped.

“I had a mandatory appointment.” She said rubbing her swelled stomach.

“I suspect you are Mrs. Reilly Malfoy?”

“Yes, sir.” Said the blonde and sat down beside Malfoy.

“Okay, now that everyone is here, Mr. and Mrs. Malfoy, do you understand the charges filed against you?” asked the Minister.

“We do.” Malfoy said.

“And how do you plead?”

“Not guilty.”

“Bastard.” Ron mumbled.

“Who are the witnesses?” he asked Ron and Hermione.

“Well, sir, the witnesses couldn’t be hear because Erin Malfoy, our main witness is currently in the hospital, deathly ill.” Hermione said and looked over at Malfoy who suddenly went even paler than normal.

“And Harry and Ginny Potter are sitting with her.” Ron added.

“So you have no witnesses present?”

“No sir.”

“Very well. We will get right to it, then. Mrs. Weasley, what is your account of what happened on the 15th of November of last year?”

“Well, sir,” Hermione began, “I was cooking dinner when I heard a knock on the door, I went to answer it and there was Erin standing there in a pillowcase dressed like a house-elf. I asked her who she was and she told me then…”

“What did she tell you?”

“That her name was Erin Malfoy and she had run away from them because they were mean to her because she was a squib.”

“Very well, continue.”

“So I brought her in and let her have my soup. She ate like she hadn’t eaten in days and she was very sick, always coughing. So after dinner I took her to take a bath because she had what I thought was dirt all over her. Well, some of it was dirt but she also had these horrid bruises all over her body. And she told me that she couldn’t remember the last time she’d had a bath in an actual tub.” Hermione explained.

“Hmm..” the Minister interjected, “Then what happened?”

“We went to bed and she had a dream, a really bad dream, she woke up screaming and crying and said that they were after her.”

“Whose ‘they’?”

“Her parents, Mr. and Mrs. Malfoy.” Hermione said coldly, they didn’t deserve to be called her parents.


“So the next day, I took her to Harry and Ginny Potters house and told her what happened. Erin and Jami, Ginny and Harry’s daughter, became best friends. After we left Ginny’s we went and bought her some clothes and stuff and then she started coughing again so I took her to the healer. Ron came home that Friday and we began getting threatening letters to send Erin back to the Malfoy’s. So we were about to move to somewhere safe but then before I could file the accusation, he kidnapped Jami Potter and threatened to kill her if we didn’t give Erin back. And that’s why he was arrested.”

“What proof do you have? Do you have the letters? The police report? Documentation of the bruises and illness?”

“She was bloody taken! The whole Auror’s Department will tell you! He was arrested and charged with kidnapping.” Ron said angrily.

“Well, the kidnapping is another case, then. Today is about the custody of Erin Malfoy. I need the papers or the letters or something.”

“Er… yeah, let me find them.” Hermione dug into the pockets of her coat hoping that the papers and pictures would still be there. She felt around until… finally her fingers brushed against paper-like material. She pulled it out and looked at it. It was Erin’s card. Hermione smiled… until she remembered that the whole courtroom was watching her and waiting for her to present papers.

“Er.. I think I left them at the house.” Hermione admitted.

“Well, then, let’s here your side of the story.” He looked at the Malfoy’s.

“Well, me and my wife had been looking for a new house on the same road that Mr. and Mrs. Weasley live on on November 15,” Reilly began smoothly holding Malfoy’s hand in the one that she wasn’t flaunting her stomach with.

“We told Erin to wait outside while we looked and when we came back out, Erin was gone! She was never grateful to how much we loved her and would hit us sometimes.” she started to ‘cry’.

“We… we thought that we would never see her again and we.. we just love her so much and want her baby brother or sister to have Erin in his or her life.” Reilly finished.

Ron rolled his eyes, “Bunch of garbage is what that is!” he whispered to Hermione. She nodded.

The Minister watched the crying woman sadly and Hermione knew that he was leaning their way.

“Do you have anything to add Mr. Malfoy?” he asked.

“Just that I couldn’t believe it when I found out that a charge of abuse was being filed again us for hitting our daughter. She means the world to us. I mean, you have a daughter, how would you feel if you were accused of this?” Hermione saw a tear run down Draco’s face and wondered why the hell he was doing this for a daughter that he hated so deeply and obviously. If only she had the papers and Harry and Ginny and Erin with her she would beat them down.

“Do you have any witnesses to your story, Mr. Malfoy?”

“Yes, my mother, Narcissa Malfoy and my friend, Blaise Zabini.”

“Come forth.” The Minister demanded.

An older, white-blonde haired lady walked forth.

“Thank you. I am just here to testify to how much my son and daughter in law loved their little girl. Even though she was a little ungrateful brat to them, they still loved her. I was with him the day he supposedly kidnapped the baby and he did no such thing.”

“Thank you Mrs. Malfoy.” Narcissa nodded her head slightly and walked back to her spot.

“Mr. Zabini?”

“Yes, sir. I was with Erin the day before she disappeared and she told me that she hated her parents because they didn’t buy her some toy. She said that she planned to run away.”

“Thank you.” The Minister dismissed him; he too bowed and sat down.

“Well, Mr. and Mrs. Weasley, if you have no proof or witnesses at all, then I am going to have to give them their daughter back.”

Hermione looked up and in shock, unable to speak.

“What, can’t you see that they are lying!?! Erin is in the bloody hospital! You can’t seriously give her back, she’ll be killed!” Ron yelled.

“Mr. Weasley, control yourself. We have no choice. I hereby give Erin Malfoy back to---"

“WAIT!!!!” the court door flew open and in came Parvati, Ginny and Harry. Parvati was pushing a very conscious Erin in a wheelchair.

“Who is this!?” cried the Minister.

“Our witnesses.” Hermione whispered.

“Excuse me?”

“Our witnesses!” Hermione jumped.

“ERIN! Oh my! What’s wrong baby, come to Mummy!” Reilly screamed and ran towards the on –coming party.

Erin froze upon seeing her real parents and her eyes grew wide, “Don’t worry, Daddy’s here.” Draco soothed.

Erin pulled her feet close to her body and began shaking slightly.

“No… no..” Erin shook her head. Everyone stood and watched as Reilly and Draco ran to their child.

“Erin, honey,” Reilly began.

“Go away.” Erin whispered.

“What? I’m you Mum.”

“No.” Erin climbed down out of the wheelchair and tried to steady herself. Reilly and Draco grabbed her as if to hug her.

“Let GO!” Erin tried to yell, but they held on.

“Let. Her. Go.” Ron said, his face a deep red in anger.

Hermione ran over and drew her wand, “Let her go, now.” She ordered.

“Mrs. Weasley this is not—"

“Mummy!” Erin said and tried to move but she was being held to tightly and she was too weak.

“It’s okay.” Reilly said thinking stupidly that Erin was referring to her.

“Not you.” Hermione said coldly Reilly was so surprised at Hermione’s answer that she loosened her grip on the little girl and Hermione was able to pull Erin out of her grasp. Erin hugged Hermione’s neck.

“Don’t let them take me.” She whispered.

“I won’t.” Hermione vowed.

“Now, there are witnesses to prove their case!” Ginny said fiercely to the Minister.

“But its too late.” The Minister argued.

“I don’t think so.” Harry said, “Look, if you try to make Erin go back to live with them then neither Ron nor I will not be responsible for our actions.”

“Is that a threat, Mr., Potter?”

“You bet it is.” Harry said looking the Minister straight in the eye.

“We will hear you case, but their must be conclusive evidence to change my mind.”

“Oh, there will be.” Parvati said, waving a Manila folder labeled ‘Erin Weasley.’

“Defiantly.” Ginny agreed holding all of the letters from Malfoy.

“Minister, this is not allowed, you must let my daughter go home with my wife and I this instant.” Draco said.

“We will hear their case, if you will please sit.” The Minister said.

Malfoy opened his mouth to protest but decided against it and sat down.

“In here, I have not only evidence of Erin’s bruises and illnesses when she came with Hermione but also her records from previously.” Parvati laid the folder on the counter and the Minister summoned it. While he looked through it, Ron made three more chairs appear ot of thin arir and they all sat down.

“Mrs. Er.. what did you say your name was?” the Minister asked passing the folder onto the other people.

“Healer Thomas.”

“Healer Thomas, there are no previous medical records other than the ones on November 16th and the day she was born.”

“Exactly, Erin Malfoy has only been in a doctors office twice in her life time.”

“Minister, Erin was the healthiest child ever—" Draco tried to interject.

“No she wasn’t, she had major lung problems that develop when a child is very young.” Parvati explained.

“Well, you see… “ Reilly was silenced by the Ministers hand.

“That’s enough, we will hear from you again later, if it is necessary. Now, What do Mr. and Mrs. Potter have to bring to this case?”

“I am holding the letters from Mr. Malfoy…” Ginny began and set the letters down to be summoned. “I also saw Erin the second day and she didn’t look good at all, sir.” Ginny started, “She was covered in bruises and looked like she had never seen a toy in her life.”

“Thanks you.” Said the Minister, summoning the letters, he read them and then passed them on, “Now, I want to hear from Erin, herself.”

“I don’t think that she is strong enough.” Hermione said sharply, “She was just in the hospital.”

“I’ll talk, Mummy. It’s okay.” Erin reassured her, lifting her head off of Hermione’s shoulder and turning to face the Minister.

“Were your Mummy and Daddy mean to you?”

“They are not Mummy and Daddy, anymore.” Erin said, crossing her little, skinny arms stubbornly.

“Fine, were Draco and Reilly mean to you?” he asked. Erin looked over and Draco and Hermione followed her eyes, Draco gave her a ‘don’t say anything or else look.’ Ron must have seen it too because he took Erin’s hand in his and said, “It’s okay, he can’t hurt you now.”

Erin nodded “Y—yes.” She gulped.

“What did they do?” the Minister asked.

“They hit me,” Erin swallowed trying to hold tears of the painful memories back, “And they called me names and wouldn’t let me in the house.”

“What names?” by now, Erin was crying.

“Squib! Okay? She’s bloody four years old, she’s not old enough for this!” Hermione cried and pulled Erin close to her chest.

“That’s ridiculous!” Draco called, “She’s a bloody liar! I’ll bet she’s not even sick!”

“Mr. Malfoy! That’s enough!” the Minister yelled.

“Wait!” Erin suddenly pulled away from Hermione and tore of the shoe and sock of her right foot.

“What is it, honey?” Hermione asked and looked over at Draco and Reilly, both of who had gone pale(r than normal).

Erin brought her foot over her lap and Hermione looked at the bottom of it. The bottom of Erin’s foot seemed to glow a light green.

“It’s a—" Erin tried to say quickly but she couldn’t finish, she started shaking violently right in Hermione’s lap.
